Indian Council of Medical Research (ICMR) Guidelines

In 2021, the Indian Council of Medical Research (ICMR) has issued guidelines for surrogacy. According to the guidelines, only the infertile and legally married Indian couple can opt for surrogacy with a maximum age limit of 55 years for the male partner and 50 years for the female partner. The couple should have been married for at least five years and have a proven infertility of at least five years. They must also provide a certificate of infertility from a doctor and a certificate of marriage from the appropriate authority.

In order to avail surrogacy services in India, the intended parents must first register with the appropriate authority and undergo a series of medical and psychological evaluations. Once approved, the intended parents will then be matched with a suitable surrogate, who will also undergo a series of evaluations to ensure that she is physically and mentally fit to carry a pregnancy.
